01 — Acceptance of Terms
By accessing and using this platform, you accept and agree to be bound by the terms and provisions of this agreement. EnergIQ reserves the right to update these terms at any time.
02 — SaaS Subscription & Licensing
EnergIQ is provided as a managed software-as-a-service under your agreed subscription plan. Access is licensed, not sold, and is limited to the users, modules, and entitlements in your agreement. Accounts may not be shared, resold, or sublicensed without written consent.
03 — Intellectual Property
The KinetIQ™ AI engine, platform architecture, and all associated algorithms are the exclusive property of EnergIQ. Unauthorized reproduction or reverse engineering is strictly prohibited.
04 — User Responsibilities
Users are responsible for maintaining the confidentiality of their account credentials. Any activity occurring under your account is your responsibility. You agree to use the platform only for lawful industrial purposes and to comply with applicable export, sanctions, and data-protection laws.
05 — Data Sovereignty
We respect the data sovereignty of our industrial partners. Your operational data, including P&IDs and asset registries, remains your property and is utilized solely for service provision.
06 — Data Handling & Processing
EnergIQ acts as a processor of your operational data on documented instructions and under a data-processing agreement. Data is encrypted at rest (AES-256) and in transit (TLS 1.3), and access is governed by role-based controls, row-level security, and a complete audit trail.
07 — AI Governance & Transparency
KinetIQ™ recommendations are advisory. You retain human oversight, and decisions affecting safety or regulatory outcomes must be verified by authorized personnel. Model outputs are logged for auditability, and training data governance follows our published AI policy.
08 — Security Posture
We operate a defense-in-depth program: network and edge controls, application-level security, identity and access management, data encryption, AI governance, audit and compliance monitoring, and deployment sovereignty options. Security posture, standards coverage, and retention are described on our Security page.
09 — Platform Availability
While we strive for 99.9% uptime, EnergIQ does not guarantee uninterrupted service. Maintenance windows will be communicated 48 hours in advance.
10 — Limitation of Liability
EnergIQ provides predictive analytics as an advisory tool. We are not liable for operational decisions made based solely on AI recommendations without human verification.
